When so much is riding on the resolution of your divorce issues, you need to know that your rights are well protected and that your interests are in good hands. Contact us today at our office in Troy to schedule a consultation. We serve clients in the Albany area, the Capital District, and throughout New York state.
In New York's Unified Court System, Joanne P. Monagan served as the Principal Court Attorney for the Rensselaer County Family Court and the State Supreme Court. In that capacity, she administered hundreds of family law cases from beginning to end, including court conferences, negotiations, trial preparation and the drafting of final decisions.
Asset Valuation and Division
Complex matrimonial law and divorce cases often involve complicated issues of asset valuation and property division. The assets to be divided can include:
- Bank accounts
- Businesses − often small, family or closely held businesses
- Stocks, bonds and other investments
- IRAs, 401(k)s, and other retirement accounts
- Income generated by professional licenses and educational degrees
Valuing property interests like these can be complicated. We work with our network of financial experts to make sure assets are properly identified and valued.
Are there hidden assets, perhaps from an undisclosed bank account? Or has there has been waste or dissipation of marital assets, such as can occur when one spouse deliberately harms the value of an asset or has chemical dependency issues that consume excessive amounts of the couple's financial resources?
To avoid a prolonged "battle of experts" with your former spouse, it's important that we undertake a thorough investigation − what lawyers call discovery − right away. We don't want you to miss out, so we are proactive about identifying assets and making sure they are valued correctly.
Child Custody Issues in a Complex Divorce
In New York State, child custody arrangements are typically equal unless you can prove the other party is unfit. If you believe your former spouse is indeed unfit, we can arrange for the necessary psychological or substance abuse evaluations. If adultery is an issue, our investigation will cover that as well.
